Who Pays In An Auto Accident With Injuries?

If you’re injured in an auto accident, who pays?

Good question.

Generally, you can recover personal injury protection benefits, called “PIP benefits,” from your own insurance company that will pay your medical bills, a part of your lost personal and household services, and 85 percent of your lost wages.

Your right to these benefits or some of them does not depend on how seriously you were injured or on whose fault the accident was.

Even if you caused the accident, you are generally entitled to these first-party benefits.

Your PIP medical benefits are unlimited in duration, but may have to be coordinated with other health insurance benefits available to you (dependent upon the no-fault auto insurance coverage applicable).

Wage loss and personal replacement service benefits are limited to three years’ duration and are subject to certain monthly and daily maximums.

In death cases, the surviving spouse and dependents are entitled to survivor’s benefits for three years and limited funeral benefits.
